12 On Your Side: Fake debt collector harassment

RICHMOND, VA (WWBT)- A Richmond woman says she's getting tormenting calls from a bill collector - for her deceased brother. We investigated after she called 12 for help stopping the harassment.

Cheryl Tolliver says each call concerning what she believes is a bogus debt, causes her to relive her brother's death. She wants them to stop.

People are protected under the Fair Debt Collection Practices Act.

The first call was a message left on her phone. The second call Cheryl answered. On the other end, a company called Process Server Corporation in Boston, Massachusetts.

"I?told her that my brother was deceased and she ignored it," said Cheryl.

Cheryl asked the caller, how did you get this number? Cheryl says her brother was dead when she got her current phone number. Gregory passed away March 2011.

She demanded the caller stop calling but got another dismissive response.

"She can call anytime she wants to. I felt offended and violated," said Cheryl.

I?tried contacting the company for a response.?I dialed the numbers that showed up on Cheryl's phone -?the call goes nowhere.

Cheryl got 20 calls over two weeks. She requested a statement but got nothing in writing. She did get a message threatening legal action against her deceased brother.

"A?restraining order that's going to be put in place within 42 to 78 hours if my brother or his attorney does not return their phone call," said Cheryl.

Online, I?found many complaints linked to one of the numbers. Someone writes, "Called back, can't get in touch with anyone." Another said,?"I have a pending restraining order... and do not believe this company, don't send money."

"It's also iffy as to whether or not they're in Boston," said Tom Gallagher with the Better Business?Bureau.?"I mean, it could be a mail drop. It could be anything. Heaven only knows where they are. The?BBB is reporting is that the company appears to be out of business. If they were in business, they would have earned an?F report."

It may be an attempt to get Cheryl to send money blindly.

"It may be but, they got the wrong one," said Cheryl.

The FTC says here's how to identify a fake debt collector: if the caller refuses to give a mailing address, asks you for personal information, uses high pressure scare tactics, and wants payment on a debt you don't recognize.

Call the Federal Trade Commission at 1-877-382-4357?or online at ftc.gov to file a complaint.

James Cameron Announces Three Avatar Sequels

Yesterday we got a bit of an update on the long-promised sequels to writer/director James Cameron?s 2009 film Avatar, but it turns out there?s much more to the story.? Cameron has been working on two follow-up films to the sci-fi pic over the last four years, with an eye towards filming both Avatar 2 and 3 at the same time and then releasing the sequels a year apart.? While last we heard Cameron was holed up in New Zealand finalizing the scripts for the sequels, news broke yesterday that Terminator: The Sarah Connor Chronicles creator Josh Friedman had been enlisted to pitch in on the screenplay for Avatar 2.? It just so happens that this was only one third of the story, as Fox announced today that Cameron has actually enlisted the help of four screenwriters to collaborate with him on the screenplays for not only Avatar 2 and 3, but also Avatar 4, with the first sequel poised to hit theaters (finally) in December 2016.? avatar-4-sequelFox announced today that not only will Cameron now film three Avatar sequels simultaneously, but he has hired screenwriters Josh Friedman (War of the Worlds), Rick Jaffa & Amanda Silver (Rise of the Planet of the Apes), and Shane Salerno (Savages) to collaborate with him on the screenplays in order to ?help bring his growing Avatar universe to life and to expedite the process.?? This is a major development with regards to the proposed Avatar follow-ups, and Fox notes that Avatar 2 will be released in December 2016, Avatar 3 will hit theaters in December 2017, and Avatar 4 will follow a year later.? Yes indeed, a trio of Avatar films are heading our way beginning in just a few short years.

This isn?t the first time we?ve heard word about?Avatar 4, as Cameron previously teased the the potential fourth film would be a prequel that explores the colonization process of Pandora. ?Whether that?s still the plan is unknown, but we now know that Fox is guaranteed to make a shitload of money with three sequels officially in the pipeline.

?Building upon the world we created with Avatar has been a rare and incredibly rewarding experience.??In writing the new films, I?ve come to realize that Avatar?s world, story and characters have become even richer than I anticipated, and it became apparent that two films would not be enough to capture everything I wanted to put on screen. And to help me continue to expand this universe, I?m pleased to bring aboard Amanda, Rick, Shane and Josh ? all writers I?ve long admired -? to join me in completing the films screenplays.?

It?s not specifically stated in the press release, but one assumes that Friedman, Jaffa & Silver, and Salerno will each be assigned a specific sequel on which to collaborate.? Jaffa & Silver most recently penned the script for the sequel Dawn of the Planet of the Apes and also wrote the upcoming Jurassic Park IV.? As for Salerno, his directorial debut hits theaters later this year by way of the documentary Salinger.

avatar-3-sequelsCameron hasn?t shared a screenplay credit on any of his directorial features since 1994?s True Lies, so it?s certainly telling that he has opened up the Avatar world to include four more voices.? Given that Avatar is the highest grossing movie of all time with a worldwide total of $2.7 billion, Fox has been eager to get the Avatar sequels off the ground for some time now.? Bringing in some screenwriting help to get these things moving might just be the momentum Cameron needs in order to finally get the follow-ups in front of cameras.? Whether three additional Avatar films is entirely necessary, however, is another question altogether.? Hopefully Cameron makes the extensive trek back into Pandora worthwhile, since these will likely tie him up from working on any other films until 2018 at the?absolute earliest?though he has said previously that he only wants to make Avatar movies from here on out.

Former Goldman Sachs bond trader Fabrice Tourre arrives at Manhattan federal court with his lawyers in the civil fraud case against him, in New York, August 1, 2013. On Thursday he was found liable of securities violations.

A former Goldman Sachs trader who earned the nickname "Fabulous Fab" was found liable Thursday in a fraud case brought by federal regulators in response to the 2007 mortgage crisis that helped push the country into recession.?

A jury reached the verdict at the civil trial in Manhattan federal court of Fabrice Tourre ? a French-born Stanford graduate described by Securities and Exchange Commission lawyers as the face of "Wall Street greed." Tourre's attorneys portrayed him as a scapegoat in a downturn caused by larger economic forces.?

Tourre, 34, found liable in six of seven SEC fraud claims. He faces potential fines and a possible ban from the financial industry. The exact punishment will be determined at a future proceeding.?

The SEC had accused Tourre of misleading institutional investors about subprime mortgage securities that he knew were doomed to fail, setting the stage for a valued Goldman hedge fund client, Paulson & Co. Inc., to secretly bet against the investment.?

The maneuver ended up making $1 billion for the hedge fund and its wealthy president, John A. Paulson, and millions of dollars in fees for Goldman. The SEC also sought to show that it helped earn Tourre a bonus that boosted his salary to $1.7 million in 2007.?

On the witness stand, the SEC lawyers confronted Tourre with a January 2007 email it said deliberately misled another institutional investor about Paulson's short position in the investment called Abacus 2007-AC1.?

Asked repeatedly if the information in the email was "false," Tourre responded, "It was not accurate."?

He added: "I wasn't trying to confuse anybody; it just wasn't accurate at the time."?

SEC lawyer Matthew Martens said, "We're obviously gratified by the jury's verdict and appreciate their hard work." There was no immediate response from the defense.?

In closing arguments, Martens called Tourre's testimony "surreal, imaginary, unreal, dreamlike" and told jurors that the defendant wanted them "to live in his imaginary land ... to live in a fantasy world."?

"Only if you close your eyes to the facts, you can find Mr. Tourre not liable for his actions," the SEC lawyer said.?

Tourre's attorney, John Coffey, countered that the government had "unjustly accused him of wrongdoing."?

Coffey urged jurors to put the investment's failure in perspective, noting that all similarly packaged securities "went off the cliff as well" after 2007.?

The civil case had been called the most significant legal action related to the mortgage securities meltdown, but it lacked the drama and high stakes of white-collar criminal cases. Much of the testimony was devoted to the intricacies of synthetic collateralized debt obligations, or CDOs ? a complex type of investment central to the case.?

Some of the testimony focused on a personal email Tourre sent to his girlfriend in France. The SEC lawyers said the missive proved the hubris of a man at the center of a massive fraud, while the defense claimed was "an old-fashioned love letter" penned by a young trader who was full of self-doubt and angst over upheaval in the financial world.?

Writing in French, Tourre said of the financial markets: "The whole building is about to collapse anytime now."?

"Only potential survivor, the fabulous Fab ... Standing in the middle of all these complex, highly leveraged, exotic trades he created without necessarily understanding all of the implications of those monstrosities!!!"?

Pressed by Marten on what he meant, Tourre said, "I didn't create any monstrosities."?

Goldman settled with the SEC in 2010 by paying a $550 million fine without admitting or denying wrongdoing. Tourre left the firm in 2012.?
